Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the ActiveQRs website and service (the "Service") operated by PegasusTech Works ("us", "we", or "our"). Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms.
1. Accounts
When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.
2. Use of Service
You agree not to use the Service for any unlawful purpose or any purpose prohibited under this clause. You agree not to use the Service in any way that could damage the Service, the reputation of PegasusTech Works, or the general business of PegasusTech Works. You are responsible for the content you link to via the QR codes you create ("Destination Content"). We do not endorse and are not responsible for any Destination Content.
3. Service Plans and Termination
The Service is offered under different plans, including a free tier with specific usage limits. We reserve the right to modify these limits at any time. We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
4. Intellectual Property
The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of PegasusTech Works and its licensors.
5. Limitation of Liability
In no event shall PegasusTech Works, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
6. Disclaimer
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.
7. Governing Law
These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which PegasusTech Works is established, without regard to its conflict of law provisions.
8. Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
